Welcome to Immifiler. These Terms of Service ("Terms") govern your use of the NVC Fee Payment Service ("Service") provided by Nutshell.sh Limited, a Delaware corporation doing business as Immifiler ("Company," "we," "us," or "our"). By using our Service, you agree to these Terms.
1. Definitions
- "Service" refers to the NVC Fee Payment Service provided by Immifiler, which facilitates payment of National Visa Center (NVC) fees on behalf of customers.
- "NVC" refers to the National Visa Center, a division of the U.S. Department of State.
- "Government Fees" refers to the official fees charged by NVC, including the Immigrant Visa (IV) Application Processing Fee and the Affidavit of Support (AOS) Fee.
- "Service Fee" refers to the fee charged by Immifiler for facilitating the payment.
- "Customer," "you," or "your" refers to the individual or entity using our Service.
- "CEAC" refers to the Consular Electronic Application Center, the U.S. Department of State's online portal for visa processing.
2. Service Description
2.1 What We Do
Immifiler provides a payment facilitation service for individuals who need to pay NVC fees but do not have access to a U.S. bank account. We:
- Accept payment from you via credit card, debit card, or other accepted payment methods
- Pay the NVC fees on your behalf through the official CEAC portal using our U.S. bank account
- Provide you with confirmation of payment, including the official CEAC receipt
2.2 What We Are Not
- We are NOT a money transmitter. We do not transfer, hold, or store your funds. We receive payment for a service and immediately use our own funds to pay NVC on your behalf.
- We are NOT immigration attorneys or consultants. We do not provide legal advice, immigration advice, or representation.
- We are NOT affiliated with the U.S. government, NVC, USCIS, or any government agency.
- We do NOT guarantee visa approval. Payment of NVC fees is one step in the visa process; approval is solely at the discretion of U.S. government officials.
2.3 Processing Timeline
We process NVC fee payments within 3-5 business days of receiving your payment. Business hours are Monday through Friday, 9:00 AM to 6:00 PM Eastern Time, excluding U.S. federal holidays.
3. Eligibility
To use our Service, you must:
- Be at least 18 years of age. By using the Service, you represent and warrant that you are at least 18 years old. We reserve the right to request proof of age and to refuse or terminate service if you cannot verify your age.
- Have a valid NVC case number and invoice ID
- Provide accurate and complete information
- Have legal authority to authorize payment for the case
4. Pricing and Payment
4.1 Fee Structure
Our pricing includes two components:

Government Fees (pass-through at exact NVC rates):
- Immigrant Visa (IV) Application Processing Fee:
- Family-based visas (IR, F1-F4): $325 per applicant
- Employment-based visas (EB1-EB5, including EB2-NIW): $345 per applicant
- Affidavit of Support (AOS) Fee: $120 per case
- Immigrant Visa (IV) Application Processing Fee:

Service Fee (our fee for payment facilitation):
- IV Fee Only: $79 base + $39 per additional applicant
- AOS Fee Only: $59 (flat rate per case)
- Both Fees: $119 base + $39 per additional applicant
For cases with multiple IV applicants (e.g., family petitions with derivatives), Government Fees are charged per applicant and Service Fees include a $39 charge per additional applicant beyond the primary applicant.
4.2 Payment Methods
We accept payment via:
- Credit cards (Visa, Mastercard, American Express, Discover)
- Debit cards
- Other methods as displayed at checkout
4.3 Payment Processing
Payment processing is handled by our third-party payment processor. By submitting payment, you authorize us to charge your selected payment method for the total amount displayed.
5. Refund Policy
5.1 Before Invoice Payment
If you have submitted a request but have not yet paid our invoice, you may cancel at any time with no charge.
5.2 After Invoice Payment, Before NVC Payment
If you have paid our invoice but we have not yet submitted payment to NVC, you may request a refund. You will receive a refund of the amount paid minus actual payment processing fees charged by our payment processor (typically 3.3% + $0.30 for card payments, but may vary by payment method).
5.3 After NVC Payment Submitted
Once we have submitted payment to NVC, NO REFUNDS are available. This includes:
- Government Fees: NVC fees are non-refundable once paid. We cannot recover these funds.
- Service Fee: Non-refundable once NVC payment has been initiated.
5.4 Incorrect Information
If you provide incorrect case information (wrong case number, invoice ID, or applicant details), and we make a payment based on that information:
- We are not responsible for payments made to incorrect cases
- No refund will be provided for Government Fees
- Service Fee refunds are at our sole discretion
5.5 Requesting a Refund
To request a refund (where eligible), contact us at support@immifiler.com within 7 days of your payment.
6. Customer Obligations
By using our Service, you agree to:
6.1 Provide Accurate Information
- Provide your correct NVC case number in the required format
- Provide your correct invoice ID as shown in your NVC correspondence
- Provide the correct applicant name(s) as they appear in NVC records
- Provide a valid email address for communications
6.2 Verify Before Submitting
- Double-check all information before submitting your request
- Ensure you have selected the correct fee type(s)
- Confirm the number of applicants if applicable
6.3 Respond Promptly
- Monitor your email for communications from us
- Respond promptly if we request clarification or additional information
- Notify us immediately if you discover an error in your submission
6.4 Accept Responsibility
You accept full responsibility for the accuracy of the information you provide. We rely on your information to make payments on your behalf.
7. Disclaimers
7.1 No Legal Advice
We do not provide legal advice, immigration advice, or any advice regarding your visa case. For legal questions, consult a licensed immigration attorney.
7.2 No Guarantee of Visa Approval
Payment of NVC fees does not guarantee visa approval. Visa decisions are made solely by U.S. government officials based on your eligibility and application materials.
7.3 Government Processing Times
We have no control over NVC or USCIS processing times. Once fees are paid, all further processing is handled by the U.S. government.
7.4 Third-Party Services
Our Service relies on third-party services including payment processors and the CEAC portal. We are not responsible for outages, errors, or issues with these third-party services.
7.5 Service Availability
We strive to provide reliable service but do not guarantee uninterrupted availability. We may suspend service for maintenance or other reasons with or without notice. If service is suspended after you have paid but before we have submitted payment to NVC, we will either process your payment when service resumes or issue a refund per Section 5.2, at your choice.
8. Limitation of Liability
8.1 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.
8.2 Exclusion of Damages
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Visa denial or delays in visa processing
- Travel costs or missed travel plans
- Emotional distress or inconvenience
- Any damages arising from incorrect information you provided
8.3 Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to: government actions, natural disasters, system outages, or acts of terrorism.
9. Dispute Resolution
9.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact us at support@immifiler.com to attempt to resolve the dispute informally. We will work in good faith to address your concerns.
9.2 Small Claims Court
You may bring claims in small claims court in your jurisdiction if your claim qualifies under that court's rules.
9.3 Binding Arbitration
For disputes involving claims exceeding $10,000, you agree to resolve the dispute through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Arbitration will be conducted in English
- Arbitration will take place remotely via video conference, or if in-person arbitration is required, in Wilmington, Delaware
- The arbitrator's decision will be final and binding
- Either party may seek enforcement of the arbitration award in any court of competent jurisdiction
9.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
9.5 Exceptions
This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
11. General Provisions
11.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Immifiler regarding the Service.
11.2 Modifications
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
11.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
11.4 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
11.5 Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
